Everything You Need to Know About the David Protein Bar Class-Action Lawsuit

David Protein, with its sleek gold packaging, TikTok-first marketing strategy, and its bars boasting impressive nutritional value (0 grams of sugar, 28 grams of protein, and 150 calories) has successfully captured the zeitgeist. So much so that last week, when a lawsuit that alleged that the protein bars might actually have as much as 83 percent more calories and 400 percent more fat than listed on their nutrition labels went viral, it sparked a public outcry. On TikTok, users compared David to Kälteen, the fictional bars Regina George ate in Mean Girls that made her rapidly gain weight. “David Protein Bars are actually Fat Bars,” wrote one TikTok user. The David co-founder and CEO hit back with a statement on March 12th. “Our products are labeled correctly and in full compliance with all FDA regulations,” Peter Rahal wrote. “The claims in this lawsuit are meritless and reflect a fundamental misunderstanding of basic, well-established scientific principles regarding how calories are determined under U.S. nutrition labeling standards for ingredients like EPG [esterified propoxylated glycerol].” While the suit …

Filed Thursday in San Diego by Escondido resident Anatasia Chernov and Big Bear resident Bianca Johnston, the lawsuit claims Costco’s in-store signage and website falsely “create an overall net impression that the Rotisserie Chicken does not contain added preservatives.” The suit alleges these claims are untrue, as “the Rotisserie Chicken is made with two added preservatives—sodium phosphate and carrageenan.” “The presence of sodium phosphate and carrageenan, added preservatives which function as such in the Rotisserie Chicken, contradict the overall net impression that Costco’s ‘No Preservatives’ representations and advertising create,” the lawsuit states. The plaintiffs say consumers rely on …

Kalshi faces class-action lawsuit over ‘deceptive’ claims denying gambling platform status

A group of regular Kalshi users, some of whom are self-professed addicts, have filed a class-action lawsuit against the prediction market over its claims that it is not a betting platform. Alexander Hallman, Jeremy Kravetz, Daniel Greenberg, Nathaniel Bee, and Abhijn Gutta are the plaintiffs, who have all reportedly lost money to Kalshi through various means. Part of this is “related deceptive and misleading business practices,” which have been highlighted online in its advertisements. One advert detailed in the suit positions Kalshi as a way to get out of debt. The advertisement features a woman unable to pay her rent, but then “got two years of rent through Kalshi’s predictions.” However, this has not been independently verified by ReadWrite. This ad I had not seen before was in the new class action against Kalshi. I think we should all be able to agree on this: Advertising that if you are short on money, prediction markets are a good idea to fix that problem is at best misguided and at worst evil. pic.twitter.com/9To9JXhJuU — Dustin Gouker …

DraftKings faces down seven state wide class-action lawsuit over gambling limits

DraftKings has been hit with a lawsuit accusing the betting company of breaking wagering laws in seven different states. The multi-state class-action is being headed by Michael Koester, based in Michigan, who claims that DraftKings is allowing players to increase gambling limits, circumventing state law. This type of law is implemented in Michigan, Colorado, Connecticut, Indiana, Iowa, Louisiana, and New York. However, according to court documents reviewed by ReadWrite, Koester alleges that DraftKings allows users to go around this without a waiting period before kicking in. Koester claims to know this information, as he himself has done it. According to the lawsuit, Koester has been a DraftKings user since 2021, with a spending limit implemented on December 31 of that year. Over the following year, he repeatedly got around this limit without being made to undergo the cooling-off period usually expected. “The plain meaning of this regulation is clear that once a patron establishes any responsible gaming limitations (deposit, spend, time, wager amount), there must be at least a 24-hour waiting period after patron requests …
