The administration announced the much-higher fee as a way of preventing foreign workers from taking American jobs. But U.S. District Court Judge Leo Sorokin in Boston sided with 20 states and struck down the visa policy, concluding that the executive branch exceeded its authority and violated the Administrative Procedure Act, which governs how federal agencies develop and issue regulations. “The Court finds that the Policy imposes a tax on H-1B petitions without the requisite delegation by Congress,” Sorokin wrote. H-1B visas are meant for high-skilled jobs that are difficult to find American workers to fill. The policy implementing the large fees on high-skilled worker visas violated the federal Administrative Procedure Act and the Constitution, Judge Leo Sorokin declared in the ruling in U.S. District Court in Boston. The Trump administration plans to appeal the ruling. “Every day, thousands of people with H-1B visas serve New Yorkers as doctors, teachers, and other skilled workers,” said New York Attorney General Letitia James, whose state is one of 20 that brought the suit. “Today a court put an end to this administration’s illegal attempt to destroy this critical program and the many jobs it makes possible,” James said. The H-1B program offers 65,000 visas annually, with another 20,000 visas for workers with advanced degrees, approved for three to six years. Technology companies in particular rely heavily on workers who receive H-1B visas. Employers seeking a visa for a foreign worker before Trump’s proclamation typically paid about US$2,000 to US$5,000 in fees depending on various factors. The fee will not apply to visas granted to foreign citizens already in the United States on student visas, who generally make up a large share of new H-1B recipients. The increase in fees has discouraged H-1B visa requests, according to court filings. As of Feb 15, US Citizenship and Immigration Services had received just 85 payments of the US$100,000 fee, the administration said in a March filing. The Trump administration has also ordered enhanced vetting of H-1B applicants and proposed a new visa selection process that would favour higher-skilled and better-paid workers. Apple today filed an emergency application with the Supreme Court, asking for a stay on App Store fee calculations while it waits to hear whether the Supreme Court will weigh in on the latest developments in its legal battle with Epic Games. Apple argues that without a stay, it will face irreparable harm. Apple says it will have to litigate the fundamentals of its business model with the “highly prejudicial taint of being (improperly) found to have acted in contempt of the court’s initial order” with the world watching, plus the case would require it to disclose confidential business information, which can’t be undone. This change means all EV owners need to pay car tax, with rates depending on the vehicle’s registration date. Apple plans to ask the United States Supreme Court to weigh in on the App Store fee restrictions and contempt of court ruling levied against it in the ongoing Epic Games vs. Apple legal battle. In a filing on April 3 (via TechCrunch), Apple asked the Ninth Circuit Court of Appeals to hold off on a plan that would see the U.S. Northern District of California decide on a reasonable commission for Apple to charge developers for purchases made from a link in an app. Apple is concerned that the district court will decide on a fee, only to have the Supreme Court then reverse the ruling in its entirety. Apple says that it does not want to make multiple major changes to its ‌App Store‌ fee structure. Instead, Apple proposes that the current no-commission setup remain in place until Apple hears back from the Supreme Court.
